#1. Acceptance of Terms

By accessing findseniorcarenow.com, users agree to these Terms. Users under 18 may not use the service. If you don’t agree to these Terms, please do not use the site.

#2. About Our Service

Find Senior Care Now LLC is a referral and matchmaking service. We connect families with assisted living facilities, memory care communities, respite care providers, and in-home caregivers.

We are NOT a healthcare provider, medical professional, financial advisor, or legal advisor. We do not deliver direct medical care.

#3. Eligibility

• Users must be 18 years of age or older.
• Users must be residents of Arizona for in-home care services.
• Users represent that all information they provide is accurate and complete.

#4. Account Registration

• Facilities and caregivers must register for accounts to use portal features.
• Account holders are responsible for maintaining the security of their credentials.
• Find Senior Care Now LLC reserves the right to suspend or terminate accounts at our discretion.

#5. Referrals and Matchmaking

• When we match families with facilities or caregivers, we provide information based on our assessment of fit.
• Final decisions about care, facilities, and caregivers are the responsibility of the family.
• We make no guarantees about specific outcomes or experiences.
• Families should conduct their own due diligence, including site visits, reference checks, and verification of licenses.

#6. Placement Fees and Payments

• Facilities pay placement fees to Find Senior Care Now LLC upon successful placement.
• Families do not pay Find Senior Care Now LLC directly for facility referrals — this service is free to families.
• In-home care clients pay Find Senior Care Now LLC directly for caregiver services per the Family Service Agreement.
• All payments are processed via secure third-party payment processors.

#7. Owner Disclosure — Affiliated Facility

The owner of Find Senior Care Now LLC also owns and operates Meadows Assisted Living, an Arizona-licensed assisted living facility located in Maricopa County.

Important financial disclosures

• Find Senior Care Now does NOT collect placement fees from Meadows Assisted Living for resident placements.
• The owner does receive ongoing rent revenue from residents who choose to move into Meadows Assisted Living.
• When Meadows Assisted Living appears in a family’s matched facility options, this affiliated relationship is disclosed to that family before any introduction is made.

Your right to choose freely

• Families are never required to consider Meadows Assisted Living.
• You may request that Meadows be excluded from your matches at any time by emailing care@findseniorcarenow.com.
• All matches are made based on the same fit criteria regardless of ownership affiliation.
• You are encouraged to evaluate Meadows the same way you would evaluate any other facility — including site visits, reference checks, and verifying its license at azdhs.gov.

#8. User Responsibilities

• Provide accurate information in assessments and forms.
• Do not use the service for unlawful purposes.
• Do not attempt to access portions of the site you are not authorized to access.
• Do not solicit caregivers or facilities outside of the platform during the non-solicitation period (see Family Service Agreement).

#9. Intellectual Property

• All content on findseniorcarenow.com (text, graphics, logos, software) is the property of Find Senior Care Now LLC.
• Users may not copy, modify, or distribute our content without written permission.

#10. Limitation of Liability

• Find Senior Care Now LLC’s liability is limited to the amount paid by the user to Find Senior Care Now LLC in the preceding 12 months, or $500, whichever is less.
• We are not liable for indirect, incidental, special, or consequential damages.
• We are not liable for outcomes at any third-party facility or with any third-party caregiver after referral.
• We make no warranties about the accuracy or completeness of information provided by third-party facilities or caregivers.

#11. Indemnification

Users agree to indemnify and hold Find Senior Care Now LLC harmless from claims arising from their use of the service or breach of these Terms.

#12. Dispute Resolution

• Any dispute will be resolved through binding arbitration in Maricopa County, Arizona.
• Governing law: State of Arizona.
• Users waive the right to class actions.

#13. No Medical Advice

• No content on findseniorcarenow.com constitutes medical, nursing, or clinical advice.
• Assessments, matching tools, and informational content are for general informational purposes only.
• Families and care recipients must rely on their own qualified medical professionals for all health decisions.
• Find Senior Care Now LLC does not diagnose conditions, recommend treatments, or make clinical judgments.

#14. Caregiver Employment and Responsibility

• Caregivers providing in-home care services through Find Senior Care Now LLC are W-2 employees of Find Senior Care Now LLC. They are not independent contractors.
• Find Senior Care Now LLC is responsible for caregiver payroll, tax withholding, and employment administration.
• Families engaging in-home care services contract with Find Senior Care Now LLC, not directly with individual caregivers.
• Families agree not to privately hire, solicit, or pay Find Senior Care Now LLC caregivers outside the platform during the engagement and the non-solicitation period defined in the Family Service Agreement.
• While Find Senior Care Now LLC screens, trains, and employs its caregivers, families are encouraged to remain engaged in their loved one’s care and to communicate any concerns to Find Senior Care Now LLC promptly.
• The specific terms governing in-home care services, caregiver conduct, supervision, incident reporting, and the responsibilities of each party are set out in the Family Service Agreement signed between the family and Find Senior Care Now LLC.

#15. Service Availability and No Guarantee of Matches

• Find Senior Care Now LLC does not guarantee that a suitable facility or caregiver match will be found for any family.
• We do not guarantee the availability of any caregiver, facility opening, or specific service at any given time.
• We may modify, suspend, or discontinue any part of our services at any time without liability.

#16. Billing, Payments, Disputes, and Chargebacks

• In-home care clients pay Find Senior Care Now LLC directly for services per the Family Service Agreement.
• Payment is due according to the schedule in the Family Service Agreement.
• Services already rendered are non-refundable except where required by law.
• Families agree not to initiate chargebacks or payment disputes for services that were properly rendered. Disputed charges must first be raised directly with Find Senior Care Now LLC and, if unresolved, addressed through the dispute resolution process in these Terms.
• Families remain responsible for payment for all caregiver hours actually worked.
• Initiating a fraudulent chargeback does not relieve a family of payment obligations.

#17. Electronic Communications Consent

• By providing a phone number or email address, users consent to receive communications from Find Senior Care Now LLC, including service-related and informational messages, by email (via our email provider) and SMS/text message (via our SMS provider).
• Some messages may be sent using automated systems.
• Message and data rates may apply to SMS messages.
• Message frequency varies.
• Users may opt out of SMS messages at any time by replying STOP, and may opt out of marketing emails using the unsubscribe link. Opting out of service-related communications may affect our ability to provide services.
• For help, users may reply HELP to a text message or contact care@findseniorcarenow.com.

#18. Prohibited Uses

Users may not: scrape, harvest, or extract data from the site; use the site for unauthorized commercial purposes; upload or transmit malicious code; attempt to gain unauthorized access to any portion of the site or its systems; harass, abuse, or harm other users, caregivers, or facilities; impersonate any person or entity; or use the site for any unlawful or fraudulent purpose.

#19. Termination and Suspension

• Find Senior Care Now LLC may suspend or terminate any user’s access at our discretion, including for: violation of these Terms, abusive or fraudulent conduct, nonpayment, or conduct that endangers caregivers, staff, or others.
• Termination of an account does not cancel or waive any outstanding balances owed to Find Senior Care Now LLC.
• Find Senior Care Now LLC may retain certain data after account termination as described in the Privacy Policy and as required by law.

#20. General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, Disclaimer, and any applicable signed agreements (such as the Family Service Agreement), constitute the entire agreement between the user and Find Senior Care Now LLC regarding the website and services.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

Force Majeure

Find Senior Care Now LLC is not liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, pandemics, public health emergencies, labor shortages, utility or communications failures, or government actions.

No Third-Party Beneficiaries

These Terms do not create any rights for any third party.

Assignment

Find Senior Care Now LLC may assign or transfer these Terms and its rights and obligations, including in connection with a sale or transfer of the business. Users may not assign their rights under these Terms without our consent.

Website Accessibility

Find Senior Care Now LLC strives to make findseniorcarenow.com accessible and aims to follow recognized accessibility guidelines (WCAG 2.1 AA) as a goal. We cannot guarantee compatibility with every assistive technology. Users who encounter accessibility barriers may contact care@findseniorcarenow.com to request assistance or accommodations.

#21. Changes to Terms

We may update these Terms at any time. Continued use of the service constitutes acceptance of the updated Terms.
